think it would work? whos in for the worst show ever?
i am. be sure to make some podcasts.
setup a how to site and say your name is Kid Chriss
i think what got my on the cybersquatting is the fact i had it forwarded to another domain…of mine.
so if i just take the site down, i think i am ok in owning the domain….and if he wants to buy it he can….
for the right price….lol
otherwise he is stuck using the gay ass domain kiddshow.com
they can, and will, take that domain from you. Either that, or they’ll just make you let it expire (like amazon does to all their people).
Don’t offer it for sale, no matter what… they’re probably just waiting for you to do something like that so they can bust your happy ass up in court.
Even if you started your own show, it wouldn’t matter.. he’s got KiddChriss trademarked. You’d have to prove you had the show prior to the trademark.
Also, FYI, they HAVE to defend their trademark in order to keep it. If they let you slide, or buy it from you or anything like that, it opens up heaps of legal problems for them.
It’s not going to happen. Suck up the $10 and walk away.
well i just faxed my letter off to a lawyer firm in portland….lets see what they say….since this lawyer of his already offered me some shwag and shit yesterday…..i dunno…

i cannot find the trademark, it is what is known as a common law trademark i guess….

dot this.
Is your name Chris? That might help a tiny bit. Also not having a site on there doesn’t help…it would be better off actually having a real/valid site would be better.
Not sure how much you want the domain and how much trouble it is worth going through for it but you could check and make sure his trademark is valid and such. It also probably doesn’t help that it looks like he used to own the domain:
…. but it looks like it was back in 03/04 and if he let it expire and didn’t renew it since then it might help you since he obviously didn’t want it since then, until now.
hmm… maybe he’s just trying to strong arm you out of the domain then.
A common law trademark is governed by the states. If you live in a different state, he’d have to sue you for it (and actually be awarded) by a federal court.
If he doesn’t have a federally registered trademark, it’s going to be stupidly expensive for him.
I am not a lawyer, I don’t play one on TV, don’t take my advice as anything more than an opinion.

i like ur swagger tho…
welp…..looks like i gotta hand it over, the firm was gonna take it on contingency but they are scared that the company that chris works for now will back him in the lawsuit….so tons o lawyers, but he did say that i am not really doing anything wrong since the trademark per say is not a real living person…..
basically he told me to call this lawyer and ask him what he wants to give me to change the ownership and all that shit…..
lol @ started to cybersquat only when accused of it.
You’re a fucking moron.
give up the shitty site.
are you making bank on it? dont think so
are you ready to get owned in court? because you will

what are they going to sue for? the domain and tons more? the fucker dropped his own site and allowed somebody else to buy it..now he wants it back?
people don’t understand that even if you’re broke, you have something to lose… it’s called a judgment. It fucks up your credit, and/or allows a person to collect wage garnishments/assets for a long time after awarded the judgment.
Q. What are the penalties for trademark infringement? Under the federal Lanham Act, the remedies for infringement include: 1. injunctive relief, These remedies are cumulative so that a plaintiff may recover not only the defendant’s profits, but also damages. In addition, both damages and profits can be adjusted by the court above those actually proven-damages to the extent three times that demonstrated, and profits to an amount that the court finds appropriate. The Lanham Act also provides that the court may order the destruction of any "labels, signs, prints, packages, wrappers, receptacles, and advertisements" in the defendant’s possession which bear the infringing mark. The Trademark Counterfeiting Act of 1984, 18 U.S.C.A. 2320 defines certain forms of trademark infringement as "trafficking in counterfeit goods", made punishable by up to 5 years imprisonment and a $250,000.00 fine. The median cost for trademark cases that go all the way to trial was estimated to be $128,000.00 in 1996, which means half the cases cost more! |
just hand that shit over, it’s not like you were making money of it.
Did you get a letter from wipo or naf?
You’re going to be giving this domain to them either way, listen to redna
Rather than give it to them, just delete it from your account. Then they can register it on their own lol.
thought they could only get you in trouble if you made money off the trademarked/copyrighted material…
I’d play with them. Just straight up say, Give me 5 g’s and its yours. See what they say
Yeah… walk right into trying to profit from a trademark infringement… that’d be smart.
im handing it over once my box of free shit arrives….i gave them a choice of donating $$$$ to a charity or sending me a fuckload of free shit…so they are sending the free shit, with instructions on transferring the domain….what a buncha faggots.
Common law trademarks are only protected in their geographic region.
"Cop Stop Donut Shop" might have been some successful 100yr old business in a well known Chicago suburb, but that doesn’t mean that it’s protected down in Dallas or anywhere else in the country for that matter. Only federally registered trademarks are protected nationwide. |
i was going to ask what country he lives in as various countries have different laws.
Bottom line is, if you havent made a penny yet, get rid of it. If you want to be an asshole, you can just tell them you do not plan on renewing and let the chips fall.
