peopleofwalmart.com v. any legal issues

does a site like this present any legal issues for posting peoples pictures? Sign off needed or since it is public place with a snapped photo, no issues?

should be sweet with a picture removal request form

I’m no lawyer but I would think there are at least a couple legal concerns…first, like you said, posting pictures of people without release. Don’t think it matters if it is a public place or not…which it isn’t, right?

Also the domain uses the trademark which could easily be taken.

Though odds are they are making plenty of money to not really care about walmart coming after the small guy lol.

I was more concerned about the pics of people. The site i’m thinking about isn’t based around walmart or any store, just the pics of people in public.

your best bet is to talk to an attorney, I am thinking there is probably some legal aspect, if you look at a lot of google map images, the people’s faces are blurred

I’m almost positive they can’t do anything until the person requests it be removed from the site or threatens legal action. Although, it’s a company because it’s not public driven which makes things a bit different.. The Walmart can be trademark infringement though, and it could be easily taken down by the company.
